These Terms of Service ("Terms") govern your use of the CreatePicAI mobile application ("the App"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
CreatePicAI lets you generate images by typing text prompts ("prompts"), optionally guided by a reference image you provide. Image generation is performed by third-party AI models accessed through our backend proxy. The App uses Google Sign-In to provide an account, a credit balance, and a cloud-synced generation history.
You must be at least 13 years old (or the minimum age required by the laws of your country) to use the App. By using the App you represent that you meet this requirement.
You agree that you will not use the App to create, request, share, or distribute content that:
We may suspend or terminate access to the service for users who violate these rules. Some prompts are filtered or rejected automatically by the underlying AI provider's safety systems.
The App uses an in-app credit system to meter image generation. Credits inside the App are a usage-tracking mechanism only, have no monetary value, are not redeemable for cash, and are not transferable between accounts. Credit purchases, when offered, are processed through the Google Play Billing system and are subject to Google's purchase terms in addition to these Terms.
Subject to the rules above and the terms of our AI provider, you own the rights to the images you generate from your own prompts, to the maximum extent permitted by applicable law. You are responsible for ensuring that your prompt and any reference image you upload do not infringe the rights of any third party. Because generated images may resemble pre-existing works, copyright protection of AI-generated content may vary by jurisdiction; we make no representation that any specific generated image is protected by copyright.
Images produced by the App are generated by an artificial intelligence model and may contain inaccurate, unexpected, or offensive results. You are responsible for reviewing generated content before sharing or relying on it. Do not use generated images for safety-critical, medical, legal, or other decisions where errors could cause harm.
You access the App by signing in with a Google account. You are responsible for maintaining the security of that account. You may sign out at any time from the Profile screen, or request full account deletion by contacting us at the support email below. We may suspend or terminate your account if you violate these Terms.
The App relies on third-party services including Google (sign-in), Replicate (AI model hosting), Render (backend hosting), and Supabase (database). Their availability, performance, and policies may affect the App. We are not responsible for outages or actions of third-party providers.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED OR ERROR-FREE OPERATION. We do not warrant that any specific result will be produced from any specific prompt.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL THE DEVELOPER BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP. THE DEVELOPER'S TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR USD 20.00, WHICHEVER IS GREATER. Nothing in these Terms limits liability that cannot be limited under applicable law (such as liability for gross negligence or willful misconduct).
We may update these Terms from time to time. When we do, we will update the effective date at the top of this page. Continued use of the App after changes take effect constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the Republic of Türkiye, without regard to its conflict of law principles. To the extent permitted by law, the courts of Türkiye shall have exclusive jurisdiction over any dispute arising out of or related to these Terms. This does not deprive consumers of the protection afforded by mandatory provisions of the law of their country of residence.
